By accessing or using AutoGuard 360 ("the Service"), operated by AutoGuard 360 ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and AutoGuard 360.
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Service. By using the Service, you represent and warrant that you meet this requirement. The Service is not intended for children under 13 years of age.
AutoGuard 360 is an AI-powered vehicle maintenance tracking and protection platform. The Service allows users to track vehicle maintenance records, scan documents using AI, receive service reminders, generate resale value reports, search for local automotive services, manage parts and fuel logs, and access AI-powered vehicle information and diagnostics.
You must provide accurate, current, and complete information when creating an account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
AutoGuard 360 offers the following plans:
Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize recurring charges. You may cancel at any time through the My Subscription page or Stripe customer portal. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. We reserve the right to change pricing with 30 days' notice.
IMPORTANT: All AI-generated content in AutoGuard 360 is for informational purposes only. This includes, but is not limited to: vehicle health analyses, resale value estimates, recall information, DIY repair guides, maintenance schedules, cost estimates, and local service recommendations.
These outputs are general industry estimates and are NOT sourced from any manufacturer's owner's manual, licensed repair database, certified appraisal service, or official recall notification system. AI-generated content may contain inaccuracies, outdated information, or errors.
Always consult your vehicle's owner's manual, a qualified mechanic, or a licensed professional for vehicle-specific advice. AutoGuard 360 and its operators are not liable for any damages, injuries, or losses resulting from reliance on AI-generated content.
The Marketplace connects users with local automotive service providers. AutoGuard 360 does not endorse, guarantee, verify, or assume liability for any services provided by third-party businesses listed on the platform. Business listings and reviews are provided for informational purposes. Users interact with businesses at their own risk and should independently verify business credentials and insurance.
The AutoGuard 360 name, logo, design, and platform code are proprietary and owned by AutoGuard 360. Manufacturer names, brand names, and vehicle model names used in the app are the property of their respective owners and are used solely for vehicle identification purposes. Their use does not imply endorsement, sponsorship, or affiliation. You may not copy, modify, or distribute any part of the Service without written permission.
You retain ownership of all data you enter into AutoGuard 360 (vehicle records, maintenance logs, photos, etc.). By using the Service, you grant us a limited, non-exclusive license to process this data solely for the purpose of providing the Service, including sending anonymized data to AI providers for analysis. You may delete your data at any time through the Settings page. We do not claim ownership of your content.
You may not:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUTOGUARD 360 LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, VEHICLE VALUE, OR GOODWILL, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless AutoGuard 360 from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and governing law) shall survive.
Any disputes arising from these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You waive the right to participate in class actions or class-wide arbitration. Small claims court actions are excluded from this arbitration provision.
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the effective date and posting the revised Terms. Continued use of the Service after changes constitutes acceptance. If you disagree with any changes, you must discontinue use of the Service.
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law principles. Any legal proceedings shall be brought in the courts of Clark County, Nevada.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AutoGuard 360 regarding the Service.
